Ineligible to Petition for Expungement:

A person is typically NOT ELIGIBLE for relief under this section if they have been convicted of any of the following crimes:

• Murder

• Kidnapping

• Rape as defined in paragraph (2) or (6) of subdivision (a) of PC 261- external link or paragraph (1) or (4) of subdivision (a) of PC 262

• Lewd acts on a child under 14 years of age, as defined in PC 288- external link

• Any felony punishable by death or imprisonment in the state prison for life

• Any sex offense requiring registration pursuant to PC 290- external link

• Escape from a secure perimeter within the previous 10 years (schedule appt. to discuss)

• Arson (schedule appt. to discuss)

Ineligible

Eligible to Petition for Expungement:

• Must have completed sentence, including jail time, fines, and community service.

• Must not be on probation or parole

• Must not have any pending criminal charges

• Must have fulfilled all court-ordered obligations.
